Website Hosting Terms and Conditions
Uptime Guarantee
Fire Pixel LLC will guarantee uptime of 99.9% availability per month. If this is not met, we will, on request in writing, credit your hosting with 1 day for each hour your site is down, up to a maximum credit of 60 days in any calendar month.
Illegal use: Fire Pixel LLC hosting services may not be used for illegal purposes, or in support of illegal activities. Fire Pixel LLC reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing.
Distribution of Viruses, Spyware, and Malware
Distributions of software that attempts to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems are prohibited. Distribution of software that monitors computer or computer user activity without the computer user\'s knowledge and consent is prohibited.
Copyright or trademark infringement
Use of Fire Pixel LLC service to transmit any material (by e-mail, uploading, posting, hot linking, directly linking or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software is prohibited.
Spamming
Spamming (sending unsolicited commercial or bulk emails) using our servers is strictly not allowed. DO NOT SEND SPAM EMAIL FROM OUR SERVERS. Sending spam emails which include links to a web site hosted on one of our servers is also forbidden. We reserve the right to suspend or terminate any site that is linked to from spam emails.
Server Use
We want to allow our customers to use our servers the best way, but in order to protect other users we may, temporarily suspend a shared hosting site if this site slows down our servers or uses too much server resource. In this case, we will try to find a solution together with the customer.
Server maintenance
We might have, from time to time, to perform maintenance, upgrades or replacements to our servers. We reserve the right to suspend access to such server during the required time to do the maintenance, upgrade or exchange the server, for no more than 4 hours. In this event, the users will be sent an e- mail at least 24 hours before the due date and time for maintenance.
Responsibility
Fire Pixel LLC will not be responsible for any damages your business may suffer & makes no warranties of any kind, expressed or implied for services we provide. Fire Pixel disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Fire Pixel LLC, its employees, suppliers, customers or any third party. You, as a Fire Pixel LLC customer, are solely responsible for the content stored on and served by your web site.
Technical Support
Fire Pixel LLC provides technical support to our customers via a support ticket system. Fire Pixel LLC will respond to your work ticket during normal business and with in 24 hours of receiving the request. Normal business hours are Monday through Friday 9am – 5pm CST.
Backups
You are solely responsible for maintaining adequate backups of your content. We may provide a backup service for your site, however, we do not accept responsibility for any backup failure which is not maintained by Fire Pixel LLC
Cancellation and Refund
Fire Pixel LLC will accept a request to cancel a web hosting account and give a full refund to any new customer who requests such refund within 30 days of ordering. Domain name registrations cannot be cancelled and are not refundable. Dedicated server plans are not refundable.
Your Website Content
You shall be solely responsible for providing, updating, uploading and maintaining your web site and any and all files, pages, data, works, information and/or materials on, within, displayed, linked or transmitted to, from or through your web site. Fire Pixel LLC shall have no liability to you or any other person for loss, damage or destruction of any of your content. You shall not use the Service in any way that shall impair the functioning or operation of Fire Pixel LLC Services or equipment. Fire Pixel strictly prohibits:
1. Content intended to advocate or advance computer hacking or cracking;
2. Gambling;
3. Illegal activity;
4. Drug paraphernalia; or
5. Hate, violence or racial or ethnic intolerance.
Security & Storage
You shall bear full risk of loss and damage to your web site and all of your web site content. You are entirely responsible for maintaining the confidentiality of your password and account information. You shall be solely responsible for undertaking measures to:
1. Prevent any loss or damage to your web site content;
2. Maintain independent archival and backup copies of your web site content;
3. Ensure the security, confidentiality and integrity of all your web site content transmitted through or stored on Fire Pixel servers; and
4. Ensure the confidentiality of your password.
In the event you terminate, moving Your web site off Fire Pixel LLC hosting servers it is Your responsibility to transfer or FTP Your web site to another provider. In the event your use of the Services is terminated, Fire Pixel will not transfer or manage your services or your web site content.
Fire Pixel LLC Rights
1. Modify its pricing
2. Establish limits and guidelines concerning the use of the AS Services;
3. Terminate your use of service for use of services to unnecessarily or illegally harass Fire Pixel LLC or third parties, non-payment of fees for the services, activities designed to defame, embarrass, harm, abuse, threaten, slander or harass third parties, activities prohibited by the laws of the United States and/or foreign territories in which You conduct business, activities designed to encourage unlawful behavior by others, such as hate crimes, terrorism and child pornography, activities that are vulgar, obscene, invasive of the privacy of a third party, racially, ethnically, or otherwise objectionable in the sole opinion of Fire Pixel LLC, activities designed to impersonate the identity of a third party, activities designed to harm minors in any way, and other activities whether lawful or unlawful that Fire Pixel LLC determines, in its sole discretion, to be harmful to its other customers, operations, or reputation.
